These Terms of Use and Service form a legally binding agreement between Tweggo Networks Limited and every user or entity that accesses, registers on, lists on, books through, pays through, or otherwise uses the Tweggo platform.

By creating an account or using any Tweggo service, you agree to these Terms, the Privacy Policy, Insurance Policy, Smart Pricing Logic, Community Standards, and incorporated schedules.

Tweggo is a technology marketplace and is not the owner of listed vehicles, transportation provider, insurer, or party to rental contracts except where expressly stated.

Platform Role and Contract Nature

Tweggo facilitates discovery, verification, booking, payment processing, telematics integration, and marketplace support.
Rental contracts are primarily between Hosts and Renters, subject to Tweggo platform rules and enforcement rights.
Tweggo may suspend listings, cancel bookings, withhold payouts, or intervene for compliance, safety, fraud prevention, insurance requirements, or dispute handling.

Eligibility, Verification, and Accounts

Users must provide accurate legal identity and keep contact, licensing, and payment details up to date.
Tweggo may require KYC checks, ID and licence verification, selfie/liveness checks, and additional due diligence.
Duplicate accounts, false information, or unverifiable details may result in rejection, suspension, restriction, or termination.

Host and Vehicle Obligations

Hosts must have lawful authority to list vehicles and ensure they are roadworthy, registered, compliant, and properly insured.
Listings must be accurate, including known defects, vehicle restrictions, accessories, and condition disclosures.
Unsafe, unlawful, or misrepresented vehicles may be suspended or delisted immediately.

Renter and Driver Obligations

Renters and additional drivers must meet eligibility rules, hold valid licenses, and be approved before driving.
Proxy bookings, fronting, unauthorized drivers, and unlawful use are prohibited.
Renters remain responsible for lawful operation, timely return, and charges arising during trips.

Pricing, Fees, and Payments

Tweggo may apply smart pricing based on duration, demand, vehicle attributes, and geography.
Current launch commercial structure includes 18% commission, VAT on commission where applicable, and a 2% service fee unless revised.
Charges may include booking fees, deposits, add-ons, tolls, penalties, cleaning, recovery, and claims-related costs.

Incidents, Insurance, and Claims

Accidents, theft, breakdowns, and damage incidents must be reported promptly and evidence preserved.
Insurance and protection products are provided by licensed third-party partners under their own terms and exclusions.
Coverage may be denied where users breach terms, allow unauthorized driving, provide false information, or violate policy conditions.

Liability, Indemnity, and Enforcement

Tweggo disclaims implied warranties to the extent permitted by law and limits liability for indirect or consequential losses.
Users indemnify Tweggo for losses arising from breaches, unlawful conduct, listing inaccuracies, or misuse of data.
Tweggo may impose penalties, withhold payouts, suspend accounts, or take legal action for policy and platform violations.

Governing Law and Disputes

These Terms are governed by the laws of Kenya, subject to mandatory local laws where applicable.
Parties should attempt good-faith resolution through support and mediation before formal proceedings.
Kenyan courts have primary jurisdiction, and Tweggo may seek urgent relief in competent courts where necessary.
